I don't have any doubts that a twelve-year old is old enough to make decisions for himself, and it is the height of arrogance for otherwise well-meaning people to think he should be kept against his will in the States. But, I don't have a particularly good feeling for his future.
And his bitterness towards America over the death of his parents can never be overcome by Americans' generosity, I'm afraid.
